Disclaimer & Limitation of Liability
This Disclaimer and Limitation of Liability explains the terms under which MP Technology provides website content, general information, recommendations, and related services.
A formal statement regarding warranties, responsibility, third-party dependencies, and liability limitations related to our website, materials, and services.
Last Updated: April 12, 2026
This notice applies to MP Technology's website, public-facing materials, business communications, and general service information. It does not replace or override any separately executed written agreement that governs services provided to a customer.
MP Technology ("MP Technology," "we," "our," or "us") provides its website, content, materials, recommendations, and services subject to the terms set forth in this Disclaimer and Limitation of Liability. By accessing or using our website, relying on information we publish, or engaging with us in connection with our services, you acknowledge and accept this notice.
This notice is intended to clarify the limits of our warranties, the allocation of responsibility between MP Technology and the customer, and the extent to which liability is limited with respect to website content, general information, recommendations, and services. Any specific obligations, service commitments, warranties, remedies, or liability terms applicable to a customer engagement will be governed by the applicable written agreement between MP Technology and the customer.
1. No Warranties
MP Technology provides its website, content, information, recommendations, tools, and services on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, MP Technology disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, availability, reliability, and uninterrupted operation.
We do not warrant that our website, communications, recommendations, or services will be error-free, uninterrupted, secure, or suitable for every environment, operational requirement, regulatory objective, or business use case.
2. Informational and General Business Use Only
Content published on our website or provided in general business communications is offered for informational purposes only. It is not intended to serve as legal advice, financial advice, insurance advice, regulatory certification, or a guarantee of technical, security, or compliance outcomes.
Any recommendations, observations, or guidance provided by MP Technology are based on the information available at the time and may depend on assumptions, environmental conditions, third-party technologies, and facts not fully known to us. Customers are responsible for evaluating whether any recommendation, configuration, or service is appropriate for their particular environment.
3. Customer Responsibility
Customers remain solely responsible for their own business operations, internal controls, security posture, regulatory compliance obligations, user activity, administrative decisions, testing, change approvals, backup strategy, disaster recovery readiness, data validation, and the ultimate manner in which any recommendations, services, configurations, or third-party products are implemented or used within their environment.
Unless expressly stated in a written agreement, MP Technology does not assume responsibility for independently verifying all customer-supplied information, business requirements, legal obligations, or environmental dependencies that may affect the suitability or outcome of a service, recommendation, or deployment.
4. No Guarantee of Results or Outcomes
MP Technology does not guarantee any particular outcome, result, savings figure, security posture, uptime level, compatibility result, performance improvement, compliance determination, or business objective unless expressly set forth in a written agreement signed by both parties.
Technical work, consulting, support, and advisory services may reduce risk or improve operations, but they cannot eliminate all operational, security, compliance, availability, or performance risks. Customer environments vary materially, and results may differ based on factors beyond our control.
5. Third-Party Products, Vendors, and Services
Many services provided by MP Technology involve or depend upon third-party software, hardware, platforms, cloud services, internet connectivity, telecommunications providers, security vendors, hosting providers, equipment manufacturers, and other external systems or suppliers. MP Technology does not control and is not responsible for the acts, omissions, failures, delays, outages, vulnerabilities, defects, changes, discontinuations, licensing actions, or performance of third-party products or services.
Any reference to, recommendation of, integration with, or use of a third-party product or vendor does not constitute a warranty or guarantee by MP Technology. Third-party offerings remain subject to their own terms, conditions, service levels, licensing restrictions, support models, and privacy or security practices.
6. Website Availability and Security
We make reasonable efforts to maintain the availability, integrity, and security of our website and related systems, but we do not guarantee that the website will always be available, uninterrupted, timely, secure, or free from vulnerabilities, malware, errors, or other harmful components.
Use of the website is at your own risk. You are responsible for using appropriate safeguards, including browser protections, endpoint security, and validation of any information before relying upon it.
7. Limitation of Liability
To the fullest extent permitted by law, MP Technology will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to the use of, inability to use, or reliance on our website, services, recommendations, content, communications, or any third-party products or services, even if advised of the possibility of such damages.
Without limiting the foregoing, MP Technology will not be liable for loss of revenue, loss of profits, loss of business opportunity, loss of anticipated savings, business interruption, loss of goodwill, loss of data, corruption of data, system downtime, restoration costs, replacement technology costs, or costs associated with security incidents, service outages, or third-party failures.
8. Service-Specific Agreements Control
If you are a customer of MP Technology under a separate written agreement, including an MSA, service order, statement of work, support terms, remote support terms, or other executed contract, that written agreement will control to the extent it conflicts with this notice. In those circumstances, this page serves as a general public-facing notice and not as the exclusive statement of terms governing the customer relationship.
Any service levels, warranties, remedies, response commitments, or liability caps applicable to a specific customer engagement must be expressly stated in the governing written agreement.
9. No Waiver of Legal Rights
Failure by MP Technology to enforce any portion of this notice will not constitute a waiver of any rights or protections available to us under applicable law, contract, or equity.
10. Changes to This Notice
We may revise this Disclaimer and Limitation of Liability from time to time to reflect changes in our business, website, services, technologies, legal requirements, or operational practices. When we do, we will update the "Last Updated" date at the top of this page. Changes become effective when posted unless otherwise stated.
